PERMIT#: M-2012-032 <br /> INSPECTOR'S INITIALS:ACY <br /> INSPECTION DATE:February 1,2022 <br /> The following inspection topic(s) were identified as having a Problem (PB), which includes correction actions <br /> and a deadline whereby the Operator must demonstrate compliance with the conditions of the Permit and the <br /> requirements of the Act and Rules. Failure to address the corrective actions by the deadline may cause the <br /> Division to escalate the Problem to a Possible Violation (PV) and schedule the issue for formal hearing before <br /> the Mined Land Reclamation Board (Board). <br /> INSPECTION TOPIC: Gen. Compliance With Mine Plan <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Mill tailings generated from the commissioning process are being <br /> stored on a liner at the Atlas TSF. The Atlas TSF has not yet been certified as an Environmental Protection <br /> Facility and cannot be utilized until the Division accepts the as-built certification. The Operator has failed to <br /> follow the conditions set forth in approved 2015 Tailings and Waste Rock Management Plan and is storing <br /> tailings outside of a certified Environmental Protection Facility. <br /> CORRECTIVE ACTIONS:The Operator shall submit the required as-built certification information pursuant to the <br /> Division's January 21, 2022 letter within thirty days. No additional tailings may be placed in the Atlas TSF until <br /> certification is accepted by the Division.The Operator shall comply with all other conditions of the approved <br /> 2015 Tailings and Waste Rock Management Plan. <br /> CORRECTIVE ACTION DUE DATE: 3/11/22 <br /> OBSERVATIONS <br /> This inspection was conducted as part of the Colorado Division of Reclamation, Mining, and Safety (Division) <br /> normal monitoring program and will serve as a quarterly inspection (Q1-2022). The Revenue Mine is an active <br /> 112d (1) underground operation located approximately 5 miles southwest of Ouray, Colorado and is accessed <br /> from Ouray County Road 26 at nearly 10,600 Feet in Elevation. Public Access to the site is controlled by a locked <br /> gate at the entrance to the site. Jesse Todd and Poppy Staub represented the Ouray Silver Mines, Inc. (OSMI) <br /> and accompanied Amy Yeldell of the Division on the inspection. The Division currently holds $517,219.00 in <br /> Financial Warranty for the site. <br /> This site has submitted an Amendment Application (AM-2)which is currently under review.The comment period <br /> closed on January 27, 2022 and the current Decision Date is scheduled for May 17, 2022. Prior to heading up to <br /> the site, the Division had a brief meeting in town at the OSMI office. Staff got clarification on a few items <br /> submitted under AM-2. These questions will be addressed through the Divisions adequacy review process. <br /> Division staff was able to meet acting CEO Buck Andrews. During the meeting the Division was made aware of <br /> another round of layoffs which primarily affected underground workers. OSMI now currently employs <br /> approximately 55 people, with 40 field personnel and 15 office personnel. <br /> Next Division staff headed up to the site. Proper mine identification signage was observed at the entrance to <br /> the mine site (Photo One). Additionally the public notice sign requirement (Rule 1.6.2(1)(b)) was also observed <br /> at both the main Revenue gate as well as the Atlas TSF gate. <br /> Page 2 of 9 <br />
