This Order included a required corrective action for <br /> Colorado Farms LLC to submit an amendment to the current financial warranty for the additional amount of <br /> $32,990.00 or submit a new financial warranty reflecting the increase, to a total of$51,632.00,within 30 days <br /> of the effective date of the Order, due by November 21, 2021. <br /> As of the date of this letter, the Division has not received the required financial warranty increase. <br /> The Division believes this is a violation of. <br /> ■ C.R.S. 34-32.5-124 for failure to comply with the conditions of an order,permit, or regulation. <br /> Therefore, the Division has reason to believe that a violation exists to the Colorado Land Reclamation Act for <br /> the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et seq., and the provisions of your Permit No. <br /> M-1988-052, and has scheduled this matter to appear before the Board. <br /> A Formal Public Hearing will be held during the February 16-17, 2022 Board meeting for consideration of <br /> the possible violation and corrective actions.Due to the impacts of the COVID-19 pandemic on the availability <br /> of State facilities and Division resources, notice is hereby given that the this Board hearing will be held by a <br /> virtual ZOOM hearing. All exhibits and materials you wish for the Board to consider related to this alleged <br /> violation must be submitted via email to the Board administrator, Camie Mojar at Camille.MojarL&state.co.us <br /> no later than 5:00 p.m. on February 4, 2022. Additionally, in order to receive an authorization code to attend <br /> the hearing,please contact Camie Mojar via telephone at 303-866-3567, ext. 8136 or by email at the addresses <br /> above. Please note, only Parties and those who will be testifying may attend the meeting via ZOOM.
