-BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF THE APPLICATION FOR 112C AMENDMENT OF <br /> ALBERT FREI & SONS, INC, WALSTRUM QUARRY; File No. M-1983-033 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> November 17, 2021 via videoconference for a hearing to consider the application of <br /> Albert Frei & Sons, Inc. ("Applicant") for a 112c Amendment, file number M-1983- <br /> 033. <br /> Jared Ebert, Peter Hays, and First Assistant Attorney General Jeff Fugate <br /> appeared on behalf of the Division of Reclamation, Mining and Safety (Division'). <br /> Albert Frei, Jr., Joel Bolduc, and Becky Ringo, Esq. appeared on behalf of <br /> Applicant. <br /> The Board, having considered presentations, testimony, materials submitted, <br /> and being otherwise fully informed of the facts in the matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. Applicant filed an application with the Division for an amendment, <br /> AM-09, to a 112c reclamation permit for a site known as the Walstrum Quarry in <br /> Clear Creek County, Colorado ("Application!). Located in Section 34, Township 3 <br /> South, Range 72 West, 6th Principal Meridian, the Walstrum Quarry would mine <br /> granite for construction aggregate to be processed at existing on-site facilities. <br /> 2. The Application proposes-expanding the area by 464.17 acres for a <br /> total permitted area of 749.3. The Application's mining plan anticipates using <br /> conventional surface mining. Approximately fifty percent of the Amendment <br /> acreage will be unaffected by the mining operation and will serve as buffers. <br /> Applicant has designated post-mining uses of wildlife habitat, privately owned <br /> natural resource area, industrial commercial development, and developed water <br /> resources. <br /> 3. During the public comment period, as mandated by Rule 1.7.1 of the <br /> Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for <br /> the Extraction of Construction Materials, 2 CCR 407-4 ("Rules'), the Applicant <br /> published notice in the Clear Creek Courant once a week for four consecutive weeks <br /> and mailed required notices in accordance with the Rules. During the public <br /> comment period, the Division received one timely letter of objection and one <br /> comment letter from History Colorado. <br />
