(ASC)in relation to the applicable Rules, <br /> Regulations and Policies. The primary focus of this review as requested is to ensure Section 6.5 of the <br /> Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction of <br /> Construction Materials have been satisfied.Additionally,the proposed geotechnical stability report <br /> conducted by Earth Engineering Consultants,LLC(EEC)was reviewed in relation to Section 30 of the <br /> Policies of the Mined Land Reclamation Board. <br /> The ASC application is proposing a total permitted acreage of 158.3 acres. The location of the site is <br /> approximately 1 mile southwest of La Salle,CO along the intersection of County Road 394 and 35. The <br /> site will be mined in four phases with contemporaneous reclamation occurring when possible to the <br /> proposed land uses within the application.ASC states that the Mine will be backfilled and graded and <br /> returned to the approximate topographic elevations that existed prior to mining operations and will allow <br /> for the proposed development of heavy industry uses as well as general agriculture operations,farm <br /> machinery and livestock. Post-mining topography is shown on Map F 1 under Exhibit F of the proposed <br /> ASC application. <br /> Rule 6.5 <br /> As required by Rule 6.5(1),ASC has provided the Division with a geotechnical stability report of the <br /> proposed slopes during active mining operations for both non-critical and critical structures conducted by <br /> EEC.As stated under Table 1 under Section 30.4 of the MLRB Policies,a non-critical structure is a <br /> structure where no imminent danger to human life exist,minor repair costs,and minor environmental <br /> impact exists if the slope fails.Under the same table of Section 30.4,a critical structure is stated to be a <br /> structure in which potential human safety risk and major repair costs exist if a slope fails.Based on the <br /> proposed operation plan and structures that exist within and/or adjacent to the proposed permit area,two <br /> different slope profiles are being proposed based on each structure designation. <br /> In order to gain subsurface conditions,a total of six exploratory boreholes were bored across the proposed <br /> permit area.
