Several sites were included in the SL-5 application,but are not included in Table 1:
• The Bear Creek B Seam Portal,Bear Creek Fan Area(U.S. Steel),Hubbard Creek Fan 91 Site
and Lower Hubbard Creek areas were all released with SL-4
• The Elk Creek Temporary Conveyor crosses the SL-I parcels,for which Phase I bond release
was already issued, and a parcel of land for which no Phase I application has been received, so it
has been removed from SL-5
• Upper Hubbard Creek(AKA Somerset Mine Hubbard Fan Shaft#1)has not been reclaimed
according to the currently approved plan, so it has been removed from SL-5. In order to make
the area eligible for bond release, Oxbow Mining,LLC should either implement the currently
approved reclamation plan, or submit a Technical Revision to revise the plan (see the MT-8
findings document for further detail).
• The Bear Creek Cutoff LU Road is not shown on Map 2.05-MI and its location could not
identified. It was not included in the SL-2 bond release, and it has been removed from SL-5.
II. CRITERIA AND SCHEDULE FOR BOND RELEASE

Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released when the
permittee successfully completes backfilling,regrading, and drainage control in accordance with the
approved reclamation plan." The reclamation plan for the Elk Creek Mine is found in section 2.05.4 of
the Permit Application Packet(PAP).
With regard to Phase I bond release,the approved reclamation plan for the Elk Creek Mine calls for:
• Removal and salvage or demolition and disposal of any surface structures and facilities not
approved for retention to support the post-mining land use
• Sealing and backfilling of all mine openings and any wells that will not be retained for
monitoring or water supply
