Proposed Decision <br /> The Colorado Division of Reclamation,Mining and Safety proposes to approve,the application <br /> for a Bond Release (SL-2) for the Hayden Gulch Loadout. This decision is based on a finding <br /> that the operations will comply with all requirements of the Colorado State Program as found in <br /> the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101 et seq., C.R.S., and the <br /> Regulations promulgated pursuant to the Act. <br /> The Division estimates liability at the Loadout, prior to the approval of SL-2 to be $1,443,270. <br /> This amount was determined using the reclamation tasks from Midterm Review MT-6 completed <br /> in November of 2020 and updated with CIRCES costs evaluated by the Division in July of 2021. <br /> With SL-2,the Division proposes to release$721,447.00 <br /> The remaining $721,823.00 is sufficient to assure completion of the remaining reclamation work at <br /> the site if the work had to be performed by the Division,including the cost of reestablishing vegetation <br /> on any revegetated areas, should those areas fail. The Division estimates its cost to complete <br /> remaining reclamation work at the site to be $721,823. <br /> Reclamation work which remains to be completed at the site are provided in Table 1 at the end of this <br /> document. <br /> Any person with a valid legal interest which might be adversely affected by this proposed decision <br /> may request a formal public hearing before the Mined Land Reclamation Board in accordance with <br /> Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the Colorado <br /> Mountain News Media -Steamboat Pilot as soon as possible. Requests for public hearing must be <br /> submitted to the Division in writing within thirty days of the first publication in the Colorado <br /> Mountain News Media -Steamboat Pilot. If no hearing is requested within those thirty days, the <br /> Division's decision will become final. <br /> 2 <br />
