<br /> <br />Notice of Proposed Decision <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to approve <br />Bond Release Application No. 2 (SL-2) for the Hayden Gulch Loadout, Permit No. C-1992-081. <br />With SL-2, the Division proposed to approve the releasing of 170.3 acres, of those 103.2 are <br />recorded as disturbed and affected and 67.1 are undisturbed. Of the disturbed acres; 91.3 acres <br />will be Phase I released, and 103.20 acres will be Phase II and III released. The loadout operation <br />is operated by Hayden Gulch Terminal, LLC under the provisions of the Colorado Surface Coal <br />Mining Reclamation Act of 1979. The bond release application was submitted by Hayden Gulch <br />Terminal, LLC on October 22, 2020. SL-2 was submitted to the Division in conjunction with Permit <br />Revision No. 2 (PR-2). PR-2 modified the approved reclamation plan and post-mining land use for <br />the major portion of the Hayden Gulch Loadout for recreational use. The former rail spur area will <br />be converted to a recreational trail for the use of residents and visitors to Hayden under a locally <br />managed “Tracks-to-Trails” program. Requests for a hearing must be made in writing within <br />thirty (30) days of the date following initial publication of this notice, and shall state with reasonable <br />specificity the reasons for the request and objections to the proposed decision. <br /> <br />
