AgeCOLORADO
Division of Reclamation.
Mining and Safety
Department of Natural Resources
January 6, 2022
Mr. Joe Forster
Jack D. Tabb, LLC
1615 Saratoga St.
Antigo,WI 54409
RE: Reason to Believe a Violation Exists and Notice of Board Hearing
Gunnell Mine; Permit No. M-2021-068
Dear Mr. Forster,
On December 9, 2021 the Division conducted an inspection of the Gunnell Mine located off of
Nevadaville Rd. in Gilpin County and found the following:
Approximately 10 cubic yards of material had been excavated from the Gunnell Mine waste rock pile
and was transported to an out of state facility for processing. In addition, approximately 25 cubic yards
of waste rock had been placed into super sacks and staged on properties adjacent to the Gunnell Mine.
Based on these findings, we believe this is a violation of:
• C.R.S. 34-32-109 for failure to obtain a reclamation permit prior to engaging in a new operation.
Therefore, the Division has reason to believe that a violation exists to the Colorado Mined Land
Reclamation Act, C.R.S. § 34-32-101 et sea., and has scheduled this matter to appear before the Mined
Land Reclamation Board(Board).
A Formal Public Hearing will be held during the February 16-17, 2022 Board meeting for consideration
of the possible violation and corrective actions. Due to the impacts of the COVID-19 pandemic on the
availability of State facilities and Division resources, notice is hereby given that the this Board hearing
will be held by a virtual ZOOM hearing.
