PERMIT#:M-1983-013 <br /> INSPECTOR'S INITIALS:ACY <br /> INSPECTION DATE:December 21,2021 <br /> The following inspection topic(s)were identified as having a Problem (PB),which includes correction actions <br /> and a deadline whereby the Operator must demonstrate compliance with the conditions of the Permit and the <br /> requirements of the Act and Rules. Failure to address the corrective actions by the deadline may cause the <br /> Division to escalate the Problem to a Possible Violation (PV) and schedule the issue for formal hearing before <br /> the Mined Land Reclamation Board (Board). <br /> INSPECTION TOPIC: Gen. Compliance With Mine Plan <br /> PROBLEM: Failure to follow approved reclamation plan, or current reclamation plan needs to be updated and <br /> clarified pursuant to C.R.S. 34-32.5-116 (1). The operator must follow approved reclamation plan or provide <br /> sufficient information to describe or identify how the operator intends to conduct reclamation. <br /> CORRECTIVE ACTIONS: The operator shall submit a Technical Revision,with the required$216 revision <br /> fee, to update and clarify the current approved reclamation plan to reflect existing and proposed activities by the <br /> corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 2/28/22 <br /> OBSERVATIONS <br /> This inspection was conducted in response to the request for an acreage reduction (AR-1) submitted to the <br /> Colorado Division of Reclamation,Mining and Safety (Division), on December 9, 2021 and was called <br /> complete on January 3, 2022. The decision date for AR-1 has been set for March 4, 2022. Tyra Bartuska with <br /> Oldcastle SW Group, Inc. dba United Companies of Mesa County represented the operator and accompanied <br /> Amy Yeldell of the Division on the inspection. <br /> The Latham-Burkett Pit is a 112c permitted site that includes a total of 140.7 permitted acres. This site is <br /> located approximately one mile south of DeBeque, Colorado in Mesa County and is accessed from Highway 6. <br /> The Division currently requires a financial warranty amount of$41,884.00 for this site. <br /> At this time the entire site except the 32 acres that includes the most northeastern lake is being requested for <br /> release. Overall site conditions remain similar to that of the May 2021 inspection. The agricultural stockpile <br /> area remains graveled and stable. The few remaining stockpiles have been removed. As have the jersey barriers <br /> and cement blocks that were near where the scale previously was located. The remaining permit areas consists <br /> of small two track roads to connect the various reclaimed ponds with limited parking areas. All of the interstitial <br /> roads and parking areas appear to be stable. <br /> The ponds were reclaimed prior to 2011 by the previous operator. This inspection was conducted during the <br /> dormant season however based on vegetative material and litter, Division staff was able to evaluate reclamation <br /> success of the vegetation. Overall the pond banks are well vegetated and consist primarily of desirable species. <br /> Slopes appear to be less than a 3H: IV with little to no signs of erosion. These ponds are adjacent to the <br /> Colorado River and have a constant supply of noxious weeds specifically, Russian Olive and Tamarisk. Some <br /> noxious weeds were present on site however the infestation did not appear to be excessive and the Division <br /> believes the site is the sink rather than the source. In general the ponds and revegetated areas appear to be <br /> ecologically stable and in good condition. <br /> Page 2 of 7 <br />
