process upon notification of the complaint and continue to transport water to the property for the
duration of the DBMS investigation. If it is determined that the operation is at fault, a new well
producing a similar or greater quantity and quality of water as the original well will be drilled at
the operator's cost. If it is determined that the operator is not at fault, resolution of the issues will
continue at the neighbor's expense. The operator will leave the temporary cistern and supply in
place and available to the homeowner for 60 days or until the repairs/replacement are completed.
In the event of a suspected change in water quality, the same consulting firm that completed the
pre-blast surveys will be contracted to complete a follow up survey and take water samples with
an operator representative, DBMS, and the neighbor in attendance. The water sample will be sent
the same lab that analyzed the water samples during the pre-blast survey. The neighbor may
choose to collect their own sample and have it analyzed by a certified laboratory of their
choosing at their own cost. For the time period that it takes the water sample to be analyzed, the
operator, at their cost, will supply household water to the neighbor.
If the water sample comes back at the same quality of sample taken during the pre-blast survey,
no further action will be taken by the operator. If the sample returns degraded water quality, the
operator will conduct a regimented weekly water sampling program, for an 8-week duration, at
the subject well and continue to provide potable water to the neighbor during the course of the
investigation. Copies of the results of this monitoring will be provided to the homeowner and
DRMS on a weekly basis. The results of this monitoring and investigation will be used to
determine any future action and/or closure of the claim.
If the DRMS determines that blasting at the quarry was the cause for the degraded water quality
and the quality never returns to the same level of the pre-blast survey, the operator will, at their
cost, drill a new well that produces a similar or greater quantity and quality of water as the
original well.
Throughout this process, the operator will review operating practices and complete an internal
investigation to determine if any operating practices could be the source of the degraded water
quality. If the internal investigation reveals practices or incidents that led to the neighbors change
in water quality; new practices will be adopted to see that no further water quality issues will be
encountered.
Young Ranch Resource
November 2020 23 X C-:I_ and Assoc 11-YLLI
