Young Jr. <br /> Young Ranch Resource LLC <br /> 5455 Ulysses Street <br /> Golden, CO 80403 <br /> Re: Clarification Regarding Letter Granting License to Utilize Public Right-of-Way <br /> Dear Mr. Young: <br /> This letter is intended to clarify a few issues regarding questions raised in connection with myprevious <br /> letter dated May 13, 2021.License to Utilize Public Right-of-Wqv("Licensing Letter"), attachedhereto as <br /> "Exhibit L" The Licensing Letter contemplates"excavation and grading activities," which should be understood <br /> to include the modification of drainage structures impacted by any such excavation and/or grading <br /> activities. <br /> Specifically,there are eleven (11)culverts located within the proposed DRMS permit boundary that <br /> convey water from the uphill side of the Central City Parkway("CCP")to the downhill side running under the <br /> CCP. Two of these culverts have outlets terminating within the proposedfill sites. These two culverts <br /> currently discharge into drop structures and then flow out into natural drainage ways located near the toe <br /> area of the existing fill sections along the CCP. <br /> The Responsible Parties and Applicant—Robert L Young Jr., Manager of the Young Ranch Resource,LLC- <br /> for the proposed project agree to work with the City to meet the following conditions related to any <br /> modification of existing drainage structures: <br /> • The proposed project shall not increase the peak flows for which the culverts, ditches, and other <br /> drainage systems were originally designed. <br /> • All drainage system modifications, installations and maintenance costs shall be borne by the <br /> responsible parties for the proposed project. <br /> • Final closure of the project site will include dedication agreements for any applicable drainage <br /> systems or other related infrastructure. <br /> • All other state and local permitting requirements shall be completed by the Responsible Parties. <br /> • Stormwater quality shall be monitored and maintained at all times by the Responsible Parties in <br /> accordance with all requirements set forth by the Colorado Department of Public Health and <br /> Environment("CDPHE"). <br /> • All associated Stormwater Monitoring Reports required to be submitted to CDPHE shall also be <br /> submitted tothe City. <br /> The following structures are located on or within 200 feet of the proposed affected area and may <br /> be impacted by mining solely at the Applicant's expense and only with prior approval from the <br /> City: <br /> l <br />
