The City has reviewed the Application and determined that the use of City right-of-way for the purposes shown therein will create a benefit to public safety by adjusting grades along the Central City Parkway. As such,pursuant to Section 11-2-40 and Section 11-2-50, Central City Municipal Code, the City hereby issues this license to Young Ranch Resource, LLC to access the City-owned right-of-way to carry out the excavation and grading activities shown in the Application. This license constitutes a legal right to enter the City-owned right-of-way to conduct mining and reclarnation as defined in the Colorado Land Reclamation Act for the Extraction of Construction Materials, C.R.S. 34-32.5-101 et seq. By signing the acknowledgment below, Young Ranch Resource, LLC agrees that it, its successors, assigns, officers, employees, contractors,and subcontractors shall enter upon City right-of-way at their own risk, and shall assume all risks of carrying out work within the City right-of-way, and further, that Young Ranch Resource, LLC will comply with all applicable laws,regulations,ordinances, approvals,and permit terms in the carrying out of the activities and operations described in the Application.
