It is sensible that the Division's adequacy review proceeds with its own assessment of <br /> jurisdictional issues. Exacting analysis under the rules brings focus to general topical concerns, <br /> and it validates concerns that warrant elaboration. In this case, the Division's extremely <br /> thorough preliminary adequacy review, and this response in turn, assesses compliance with the <br /> standards applicable to mining- and reclamation-related questions. The Division's adequacy <br /> review also includes Exhibit M, enumerating the numerous other permits and approvals the <br /> Applicant commits to obtain in this process. <br /> Through the parallel tracks of continued diligence with community members and technical <br /> review with the Division, the field of contested topics will continue to narrow as the technical <br /> record in support of the project grows to cover any remaining issues. <br /> 99. Pursuant to Rule 1.6.2(e), please submit proof of the notice sent to all owners of record <br /> of surface and mineral rights of the affected land and the owners of record of all land <br /> surface within 200 feet of the boundary of the affected lands (including all easement <br /> owners located on the affected land and within 200 feet of the boundary of the affected <br /> lands).
