Additionally, please <br /> see the revised letter and structure agreement from Central City. This agreement was signed <br /> and notarized in person; therefore, no certified mail receipt is included for this agreement. <br /> A revised structure agreement has been sent to the Goltra West Ranch, LLC; please see the <br /> certified mail receipt included in Exhibit S of the revised permit narrative. In lieu of a fully <br /> executed and notarized agreement by both parties, the Young Ranch Resource has provided an <br /> engineering evaluation as the Geotechnical Stability Exhibit to fulfill the requirements of Rule <br /> 6.4.19(b). <br /> 81. Please be advised, in the absence of fully executed structure agreements for any <br /> structures located on or within 200 feet of the proposed affected lands, which are not <br /> proposed to be impacted by the operation, the applicant must provide an appropriate <br /> engineering evaluation that demonstrates that such structures shall not be damaged by <br /> activities occurring at the mining operation, in accordance with Rule 6.4.19(b). In this <br /> exhibit, the applicant refers to the Geotechnical Stability Exhibit provided in the <br /> application for demonstration that all structures located within 200 feet of the proposed <br /> affected lands will be protected. The Division is currently reviewing the Geotechnical <br /> Stability Exhibit and will inform the applicant of any adequacy issues identified. In the <br /> event the Division determines this evaluation does not fully demonstrate structures <br /> located within 200 feet of the proposed affected lands will not be damaged by the <br /> operation, the applicant may be required to adjust the proposed mining and/or <br /> reclamation plans in a manner to protect any such structures for which an agreement <br /> has not been obtained. <br /> The applicant acknowledges the Division's continued efforts to evaluate the Geotechnical <br /> Stability Statement and commits to working with the Division to demonstrate structures within <br /> 200-feet of the proposed affected lands will not be impacted by the mining effort. <br /> 82. Please specify all existing structures located within the affected lands which will need to <br /> be relocated, removed, modified, or otherwise impacted by the operation. For example, <br /> during the August 4, 2021 preoperation inspection, the Division noted the presence of <br /> two stormwater drop structures located in the drainages proposed for the WRL, which <br /> the applicant indicated would need to be relocated. For any such structures not owned <br /> by the applicant, a structure agreement must be provided which states the owner's <br /> acceptance of any anticipated impacts (e.g., relocation, removal, modification) to the <br /> structure. This would include the applicant's proposal to realign the Central City <br /> Parkway, which requires an agreement with Central City clearly authorizing the <br /> realignment of this road(and the relocation, removal, etc. of any other structures <br /> associated with this road). <br /> Some structures related to the CCP will be impacted by mining; therefore, please refer to the <br /> modified notarized agreement between Central City and the Young Ranch Resource located in <br /> Exhibit S. <br /> December 2021 26 Lcwicki& Associates <br />
