The Colorado Division of <br /> Reclamation, Mining and Safety (The Division) has reviewed the above referenced reports. The reports <br /> were received by the Division on 8 December 2021. Sediment pond inspections were conducted by <br /> Miranda Kawcak, Jenna Spencer and Jason Herden of Seneca Coal Company. The report is in compliance <br /> with the applicable sections of Rule 4.05.9. Ponds 010 and 012 generally discharge throughout the year. 2021 <br /> was a drought year and Pond 010 did not discharge. Pond 011 tends to discharge during Q2 and holds water <br /> throughout the year. Sediment levels were acceptable. <br /> Maintenance/monitoring items noted comprise a known native spring near the Pond 013 dam, and the <br /> rusting outlet culvert at Pond 010. DRMS understands that Seneca Coal Company monitors these items on a <br /> regular basis. <br /> With a couple of exceptions,the pond inspections were received by the Division in bulk in December of <br /> 2021 for the past three years.
