© COLORADO <br /> Division of Reclamation, <br /> NNW Mining and Safety <br /> Department of Natural Resources <br /> December 1, 2021 <br /> Fred Barlow <br /> Red Feather Excavating <br /> PO Box 74 <br /> Red Feather Lakes, CO 80545 <br /> RE: Reason to Believe a Violation Exists and Notice of Board Hearing <br /> Red Feather Excavating; Permit No. M-2021-065 <br /> Dear Mr. Barlow: <br /> On November 10, 2021,the Colorado Division of Reclamation, Mining and Safety (Division) conducted <br /> an inspection of the above referenced site. The inspection was prompted by an anonymous complaint <br /> submitted to DRMS by email on November 5, 2021. <br /> The site is approximately 4 acres in size and contains several commercial buildings. During the <br /> inspection it was determined that approximately 30 cubic yards of material was excavated and removed <br /> from the site. The purpose of the excavation is to implement a stormwater plan around the existing <br /> buildings. Additional material will be removed from the site to complete the stormwater improvements. <br /> Based on these findings, we believe this is a violation of: <br /> • C.R.S. 34-32.5-109 for failure to obtain a reclamation permit prior to engaging in a new <br /> operation. <br /> Therefore, the Division has reason to believe that a violation exists to the Colorado Land Reclamation <br /> Act for the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et sea., and the provisions of <br /> your Permit No. M-2021-065, and has scheduled this matter to appear before the Mined Land <br /> Reclamation Board(Board). <br /> A Formal Public Hearing will be held during the January 19, 2022 Board meeting for consideration of <br /> the possible violation and corrective actions. Due to the impacts of the COVID-19 pandemic on the <br /> availability of State facilities and Division resources, notice is hereby given that the this Board hearing <br /> will be held by a virtual ZOOM hearing. All exhibits and materials you wish for the Board to consider <br /> related to this alleged violation must be submitted via email to the Board administrator, Camie Mojar at <br /> Camille.Moiar(&state.co.us no later than 5:00 p.m. on January 7, 2022.
