Navigation Non-navigable waters <br /> ® 2. Aquatic Life Movements Activity will not disrupt the necessary life cycle movements of <br /> those species of aquatic life indigenous to the waterbod . <br /> ® 3. Spawning Areas N/A Activities will not result in the physical destruction of <br /> spawning areas. <br /> ® 4. Migratory Bird Breeding Areas No Migratory Bird Breeding Areas will be affected. No <br /> vegetation will be cleared as a result of this project. <br /> ® 5. Shellfish Beds N/A <br /> ® 6. Suitable Material Activity will use suitable material and will be free of toxic <br /> pollutants in toxic amounts. <br /> ® 7. Water Supply Intakes No activity will occur in the proximity of a public water supply <br /> intake. <br /> ® 8. Adverse Effects from Impoundments Impoundments will not adversely effect the aquatic system <br /> due to accelerating the passage of water. <br /> ® 9. Management of Water Flows The activity will not impede or restrict the passage of normal <br /> or high flows and will not alter the pre-construction course, <br /> condition, capacity, and location of open waters in Sneffels <br /> Creek or Atlas Creek. The project will be designed to with <br /> stand expected high flows from the Revenue Mine discharge <br /> point. <br /> ® 10. Fills Within 100-Year Floodplains Activity will comply with applicable FEMA-approved state or <br /> local floodplain management requirements. <br /> ® 11. Equipment Activities will not take place within wetland areas or mudflats. <br /> The project will only affect non-wetland waters. Measures <br /> will be taken to minimize soil disturbances. <br /> ® 12. Soil Erosion and Sediment Controls BMPs will be implemented during constuction. Appropriate <br /> erosion and sediment controls will be used to properly <br /> stabilize the site and prevent erosion and siltation into <br /> wetland and other waters downstream. <br /> ® 13. Removal of Temporary Fills Temporary fills in WOUS will not take place. <br /> ® 14. Proper Maintenance All authorized structures and fill will be properly maintained <br /> to ensure public safety and will meet all compliance <br /> standards. <br /> ® 15. Single and Complete Project The activity is a single and complete project. <br /> ® 16. Wild and Scenic Rivers The activity will not impact any wild or scenic river. <br /> ® 17. Tribal Rights No reserved tribal rights will be impaired by the activity. <br /> ® 18. Endangered Species See Box 11 above. <br /> ® 19. Migratory Bird and Bald and Golden Eagle No "Take" permits will be required. <br /> Permits <br /> ® 20. Historic Properties See Box 12 above. <br /> ® 21.
