OBEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE REQUEST OF ROCKY MOUNTAIN <br /> MATERIALS AND ASPHALT, INC. FOR A SECOND PERIOD OF <br /> TEMPORARY CESSATION, File No. M-2000-052 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> October 20, 2021 in Denver and via videoconference for a hearing to consider the <br /> request for a second period of temporary cessation filed by Rocky Mountain Materials <br /> and Asphalt, Inc. ("Operator"), file number M-2000-052 ("permit"). Tim Cazier <br /> appeared on behalf of the Division of Reclamation, Mining and Safety ("Division"). <br /> Phil Cortney appeared on behalf of Operator. <br /> The Board, having considered the presentations, testimony, and evidence of <br /> the Division' and Operator, and being otherwise fully informed of the facts in the <br /> matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 112(c) reclamation permit for 193.28 acres of sand <br /> and gravel mining. The site, known as Coyote Ridge, is a designated sand and <br /> gravel operation and is located in Fremont County, Section 3, Township 20 South, <br /> Range 69 West, 6th Principal Meridian. <br /> 2. On August 19, 2021, the Division performed a regular monitoring <br /> inspection. The Division indicated to the Operator that the first period of <br /> Temporary Cessation would expire on September 25, 2021. The Division found no <br /> problems or violations at the site during the inspection. <br /> 3. On September 3, 2021, the Division received a request for a second <br /> period of Temporary Cessation ("TC-2") for the site. <br /> 4. On September 16, 2021, the Division sent Operator a notice of <br /> incompleteness indicating that the application needed to be resubmitted before the <br /> notice for the TC-2 would be considered complete. <br /> 1 The Division was advisory staff to the Board, not a party, in this proceeding. <br />
