Rule 6.5 Geotechnical Stability Exhibit <br /> 1. Patriot Powder LLC's stability and impacts report is provided in Exhibit D. <br /> Response to Topics in Timely Objections Received by DRMS <br /> • Compliance with local zoning/land use restrictions: DBC submitted a preliminary Location <br /> and Extent application to Jefferson County on August 13,2020. DBC intends to comply with <br /> applicable county regulations. <br /> • Dust and air pollution: The Golden Mine operates under CDPHE APCD Permit No.92JE940F. <br /> • Traffic: The mine operation will be consistent with clay mining of the Dakota Mine and <br /> Flintlock Mine on the same hogback. It is not anticipated that traffic will change. DBC <br /> secured the services of LSC Transportation Consultants who performed a traffic study and <br /> submitted an access permit application to CO Department of Transportation (CDOT). CDOT <br /> issued an access permit on September 3,2021. <br /> • Preservation of fossils: CO State Land Board (CSLB) shared the archeological survey report. <br /> DBC is aware of the area and will proceed as directed by CSLB. <br /> • Stormwater runoff: DBC operates under the CDPHE WQCD Stormwater Permit No. <br /> COG501852. Mining operations will be consistent with decades of mining on the hogback <br /> thus stormwater runoff issues are not anticipated. <br /> • Mine safety: DBC must operate in compliance with MSHA regulations. <br /> • Potential negative impacts to local economy and property values: The Golden Mine has <br /> operated since 1940 without negative impacts to the local economy and property values. In <br /> fact,the area has prospered both economically and property values. <br /> • Potential negative impacts to wildlife: Exhibit H addresses this concern. <br /> • Potential negative impacts to groundwater quality: The mining operation will not intercept <br /> groundwater. Exhibit G addresses this concern. <br /> • Potential negative impacts to wetlands and floodplain areas: The proposed permit <br /> boundary does not encompass wetlands and does not include floodplain areas. <br /> • Possible damage to nearby structures from mining activity: DBC assumes this is regarding <br /> the infrequent blasting performed by a state certified third party blaster. Exhibit D contains <br /> a report that addresses this concern. <br /> • Possible adverse impacts from the presence of a geologic fault on the site: Historic <br /> documents indicate the clay resource in the hogback was been mined since the mid-1800's. <br /> The Dakota Mine was mined out and reclaimed by DBC. The Flintlock Mine was mined out <br /> and reclaimed by General Shale. DBC has held the CSLB lease since 1940 and has mined in <br /> recent years. All of this mining activity has transpired without adverse impacts from the <br /> presence of a geologic fault. <br /> • Past violations against the operator: DBC is required to resolve agency compliance <br /> advisories and violations in a timely manner and will continue to do so. <br /> • Issue of completeness and adequacy in the provided application: DBC resolved <br /> completeness issues on September 8,2021. This response is submitted to address <br /> application adequacies. <br />
