The permit has one active stipulation, attached to TR-10 as follows: <br /> Stipulation 9: The permittee shall submit a technical revision and receive approval to <br /> the permit to establish a post-mining land use reclamation plan, measurement <br /> methodologies, and reclamation success requirements for lands associated with the Tie- <br /> Across Haul Road with the approved post-mining land use of Cropland. <br /> Prior to initiation of reclamation for lands associated with the Tie Across Haul Road, the <br /> permittee shall submit a technical revision to the permit which provides a reclamation <br /> plan, sampling methodologies and reclamation success requirements for the cropland <br /> areas in accordance with Rule 2.05.4(2)(e), Rule 4.15.1(2)(c), Rule 4.15.9 and Rule <br /> 4.15.7(2). The technical revision needs to be approved prior to initiation of reclamation <br /> activities associated with the Tie Across Haul Road cropland areas. <br /> HGL plans to address Stipulation 9 with a subsequent PR specifically addressing the Tie-Across <br /> Haul Road. The area of the permit associated with this stipulation is not being revised with the <br /> PR-02 proposed revisions and will remain an active stipulation. <br /> There are no specific variances and approvals by the Division for the Loadout. <br /> As of November 8, 2021,the Division estimates liability at the Loadout is $1,443,270. This <br /> amount is sufficient to assure completion of the remaining reclamation work at the site if the <br /> work had to be performed by the Division, including the cost of re-establishing vegetation on any <br /> revegetated areas, should those areas fail. This amount was determined using the reclamation <br /> tasks from MT-6 completed in November of 2020 and the current CIRCES estimated costs <br /> updated by the Division in July of 2021. <br /> 5 <br />
