The Operator shall <br /> submit the permit application within 120 days of the mailing date of this Order and <br /> obtain approval of the reclamation permit within statutory timeframes. <br /> The Board imposes a CIVIL PENALTY of$1000.00 per day of violation for a <br /> civil penalty amount of$41,000.00 and an additional civil penalty of$339.84 for <br /> costs incurred by the Division in investigating the alleged violations, for a total civil <br /> penalty of$41,339.84. The Board suspends all but $3000 of the civil penalties if the <br /> Operator completes the corrective action to the satisfaction of the Division within <br /> the required deadlines.
