COLORADO <br /> 0 Division of Reclamation, <br /> Mining and Safety <br /> Department of Natural Resources <br /> November 1,2021 <br /> Kye Abraham <br /> LKA International,Inc. <br /> 3724 47St. Ct NW <br /> Gig Harbor,WA 98335 <br /> Re: Reason to Believe a Violation Exists and Notice of Board Hearing; <br /> Golden Wonder Mine,Permit No. M-1978-091-UG <br /> Mr. Abraham <br /> On October 11,2021, the Division of Reclamation Mining and Safety(Division) conducted an inspection <br /> of the Golden Wonder Mine(Permit M-1978-091-UG). Observations made during this inspection <br /> determined that the Water Treatment System was not operational in accordance with the approved permit. <br /> Based these findings we believe this is a violation of: <br /> • C.R.S. 34-32-116(7)(g)for failure to minimize disturbances to the prevailing hydrologic valance <br /> of the affected land and of the surrounding area. Specifically; <br /> o The conveyance system designed to deliver mine water discharge to the mine water pond <br /> has been obstructing, allowing untreated mine water to bypass the treatment system; <br /> o The water treatment system is not operational, meaning that mine water and impacted <br /> stormwater is not being treated and discharged in accordance with the approved permit; <br /> o Impacted stormwater is not being monitored, treated if necessary, and discharged within <br /> 72 hours of impoundment; <br /> o All components of the water treatment system are in various states of disrepair,mainly <br /> the tank was not set on a firm foundation and the sump system at the discharge point has <br /> not been maintained, making water treatment operations impossible until repairs are <br /> made. <br /> Therefore,the Division has reason to believe that a violation exists to the Colorado Land Reclamation <br /> Act, C.R.S. § 34-32-101 et sue., and have scheduled this matter to appear before the Mined Land <br /> Reclamation Board(MLRB). <br /> A Formal Public Hearing will be held during the December 15-16, 2021 Board Meeting for consideration <br /> of this possible violation. The hearing will be held at 1313 Sherman Street, Room 318,Denver, <br /> Colorado,beginning at 9:00 a.m, on December 15 or as soon thereafter as the matter can be considered. <br /> In order to be considered at the hearing,all exhibits,materials and witness testimony you wish for the <br /> Board to consider must be submitted via email to the MLRB Administrator,Camille Mojar at: <br /> Camille.mojarLib state.co.us,no later than 5:00 PM,December 10,2021. <br /> 1313 Sherman Street, Room 215, Denver,CO 80203 P 303.868,3567 F 303.83C.8106 http;:+mining.state.co.us <br /> Jared S.
