L PROCEDURES AND SUMMARY OF THE REVIEW PROCESS <br /> MINREC, Inc. has applied for complete bond release under the Colorado Surface Coal Mining and <br /> Reclamation Act following reclamation of the North Thompson Creek Mine. This is the seventh bond <br /> release application for the site(SL-07). <br /> Five bond release applications were approved between 1988 and 2003: <br /> • The decision issuance date for SL-01 was in March 1988. This was a Phase I bond release, and <br /> the amount released was$117,920. <br /> • The decision issuance date for SL-02 was in November 1993. This was a Phase I,II,and III bond <br /> release,and the amount released was$45,000. <br /> • The decision issuance date for SL-03 was also in November 1993. This was a Phase III bond <br /> release,and the amount released was$78,267. <br /> • The decision issuance date for SL-04 was in November 2001. This was a Phase I and II bond <br /> release, and the amount released was$158,430. <br /> • The decision issuance date for SL-05 was in March 2003. This was a Phase III bond release, and <br /> the amount released was$53,497. <br /> The most recent bond release was SL-06,and the decision issuance date was January 25,2010. This action <br /> was a Phase I, II, and III bond release. After SL-06,the Division retained jurisdiction over 4.1 acres of <br /> area known as the Developed Water Resources Area;the ditches and ponds in this area have been approved <br /> as permanent. <br /> With TR-28,0.7 acres were added to the approved disturbed area(for a total of 4.8 disturbed acres)because <br /> the Refuse Pond and the ditch from Pond P-9 to the Refuse Pond were added back into the permit. The <br /> Refuse Pond and inlet ditch are an integral part of the surface water management system at the site. <br /> After SL-06,the Division also retained jurisdiction over 407 acres overlying underground workings; no <br /> reclamation tasks are associated with this area. The Developed Water Resources Area and the 407 acres <br /> overlying underground workings are part of the permit area,which encompasses 1,093.5 acres. <br /> The application for SL-07,a Phase III bond release,was received by the Division on August 4,2021. The <br /> application was deemed complete on August 13,2021, after the Division received proof of publication of <br /> the applicant's public notice. MINREC, Inc. published notice of the bond release application in the <br /> Glenwood Springs Post Independent once weekly for four consecutive weeks, beginning July 12, 2021. <br /> MINREC,Inc. also notified land owners within and adjacent to the mine permit area, and other interested <br /> parties of the application for bond release, as required by Rule 3.03.2(l). <br /> No comments, written objections, or requests for an informal conference regarding the bond release <br /> application were received by the Division. <br /> The Division scheduled and conducted a bond release inspection on September 13, 2021. The site <br /> inspection was conducted in accordance with Rule 3.03.2(2). Attendees included Stan Muhr and Jim <br /> Stover, representing MINREC, Inc.; Rob Zuber representing the Division; and Dan MacKinnon <br /> representing the Office of Surface Mining Reclamation and Enforcement.
