The issue and required response are as follows: <br /> • Because ponds at the North Thompson Creek Mine are to remain as permanent impoundments, <br /> provisions for sound future maintenance by the permittee or landowner must be made, per Rule <br /> 3.03.1(3)(c). <br /> • The operator must provide to the Division a letter from the landowner, North Thompson — Four <br /> Mile Mineral & Land Corporation, stating that they intend to continue to maintain the ponds to <br /> prevent pollution of North Thompson Creek in the future. <br /> A response letter from MINREC, Inc. was received by the Division on October 25, 2021. This letter <br /> included an attachment with an agreement for future maintenance signed by MINREC,Inc. The Division <br /> determined that this response was adequate to satisfy the adequacy requirement. <br /> II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br /> PHASE I <br /> The application is for Phase III bond release only. <br /> PHASE II <br /> The application is for Phase III bond release only. <br /> PHASE III <br /> At the North Thompson Creek Mine,there is no remaining liability for backfilling and grading, drainage <br /> control,topsoil replacement,or revegetation.
