The Division is required to make an approval <br /> or denial decision no later than October 15,2021 therefore;a response to the following adequacy <br /> review concerns should be submitted to the Division as soon as possible. <br /> The Division recommends the Applicant provides a cover letter and replacement pages in response to <br /> the adequacy concerns in this letter instead of resubmitting the entire permit application. <br /> 1.6-Public Notice <br /> 1. As required by Rules 1.6.2(d)and 1.6.3(3), please submit proof of publication in a newspaper of <br /> general circulation in the locality of the proposed mining operation. <br /> The Applicant submitted a copy of an application notice email from the Clear Creek Courant as proof <br /> of publication. The notice did not include the publication date or certification of publication from the <br /> Clear Creek Courant. Please submit proof of publication from the Clear Creek Courant pursuant to <br /> Rules 1.6.2(d)and 1.6.3(3).A copy has been added to this submittal. <br /> 2. As required by Rule 1.6.2(e),please submit proof of the notice to all owners of record of surface and <br /> mineral rights of the affected land and the owners of record of all land surface within 200 feet of the <br /> boundary of the affected land including all easement holders located on the affected land and within <br /> 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified <br /> Mailing or by proof of personal service. <br /> The Applicant's response stated,'?he district ranger has signed off on the application. This satisfies <br /> notice of all owners". The USFS approved a Plan of Operations for the site,which is a separate <br /> requirement from the Division notification process. Please submit proof of the notice to all owners <br /> of record of surface and mineral rights of the affected land pursuant to Rule 1.6.2(e).
