GSL Sand St Gravel Substitute Water Supply Plan Page 3 of 5 <br /> October 19, 2021 <br /> The current financial warranty posted for the site is $368,590, which was set by DRMS after <br /> approving an amendment request to change the reclamation plan from water storage to an inert <br /> backfill operation on the property (to two feet above the water table). This action satisfied the <br /> requirement that the Applicant diligently pursue compliance with their DRMS permit and the <br /> requirements described in the April 30, 2010 letter DRMS sent to all gravel pit operators (attached), <br /> specifically in regard to the required financial warranty at the site. With each successive SWSP <br /> renewal request, the Applicant shall demonstrate continued diligence in this effort, including <br /> maintaining satisfactory status in obtaining proper bonds through DRMS. <br /> Conditions of Approval <br /> I hereby approve this substitute water supply plan, in accordance with section 37-90-137(11), C.R.S., <br /> subject to the following conditions: <br /> 1. This SWSP is approved with the effective date of November 1, 2021 and shall be valid through <br /> October 31, 2022 unless otherwise revoked or superseded by a decree. If this plan is not <br /> decreed in water court by the SWSP expiration date, a renewal request must be submitted to <br /> this office with the statutory fee of $257 no later than September 15, 2022. If a renewal <br /> request is received after the expiration date of this plan, it will be considered a request for <br /> a new SWSP and a filing fee of$1,593 will be required. <br /> 2. Well permit no. 57723-F is in good standing for the current use and exposed surface area at the <br /> site in accordance with sections 37-90-137(2) and (11), C.R.S. <br /> 3. The total surface area of the groundwater exposed at the site must not exceed 0.90 acres during <br /> the approval period of this SWSP, resulting in annual evaporative losses of 2.59 acre-feet. <br /> 4. This SWSP does not permit any water use for dust control, aggregate production or any other <br /> purpose, other than evaporation. <br /> 5. Total consumption at the site must not exceed the aforementioned amounts unless an <br /> amendment is made to this plan. <br /> 6. Approval of this plan is for the purposes as stated herein. Any additional uses of this water must <br /> first be approved by this office. <br /> 7. All releases of replacement water must be sufficient to cover all out-of-priority depletions in <br /> time, place, and amount and should be made on a daily basis. The release of monthly <br /> replacement water may be aggregated in a single release to maximize beneficial use at the <br /> direction and approval of the Water Commissioner. <br /> 8. All diversions shall be measured in a manner acceptable to the Division Engineer. The Applicant <br /> shall install and maintain such measuring devices as required by the Division Engineer for <br /> operation of this SWSP. In addition, the applicant shall maintain daily records of all diversions, <br /> replacements, and the amount of water used for each particular purpose. The applicant shall <br /> provide a report of these records to the Division Engineer (Div1Accountinq@state.co.us), River <br /> Operations St Compact Coordinator (Brent.Schantz@state.co.us) and the Water Commissioner <br /> (Jorge Vidal at Jorge.Vidat@state.co.us) on a monthly basis. The accounting must be submitted <br /> within 30 calendar days of the end of the month for which the accounting is being made. <br /> In addition, the applicant shall verify that the entity making replacements is identifying the <br /> applicant's use specifically on the entity's accounting submitted to this office, and shall claim <br />
