If the applicant wishes to maintain the current permit boundary, but not submit a mining <br /> and reclamation plan for Phase II at this time, they must designate the area within the <br /> proposed permit boundary, located north of the southern 200' setback distance from the <br /> power lines, as"unaffected area". This would require submittal of a future permit <br /> amendment to DRMS for approval prior to initiating any mining related activity in the <br /> area of the permit located north of the southern 200' powerline setback. This option <br /> would also remove the existing requirement for submittal of a notarized damage waiver <br /> agreement to the owners of the powerlines, as they would then be more than 200' from <br /> the"affected area". <br /> 2) Previously identified in Exhibit D Mining Plan section(i)—The operator has identified that <br /> explosives will be used in the mining as proposed. In consultation with the Office, the Applicant <br /> must demonstrate pursuant to Rule 6.5(4), Geotechnical Stability Exhibit, that off-site areas will <br /> not be adversely affected by blasting. <br /> Please provide additional information with respect to the proposed blasting operations. This <br /> information should include, but not necessarily be limited to: anticipated size and frequency of <br /> blast events, maximum allowable noise and particle acceleration figures and how they will be <br /> measured and documented, who is conducting blasting and what kind of records are maintained <br /> by the blasting contractor/operator. Please also demonstrate how the proposed blasting will not <br /> adversely affect off-site areas/structures(power lines etc.). <br /> 3) The Operator has stated in the provided adequacy response that the below-grade "pit" area <br /> created by expanded mining as proposed will not be free draining, but instead will be pumped as <br /> needed to discharge retained precipitation during mining operation. This closed pit area would <br /> then be backfilled during reclamation to prevent accumulation of standing water. DRMS will <br /> therefore be required to bond for the cost of backfilling the excavated pit area to grade so that <br /> water will not be retained. In order to do so, DRMS will need to know the volume of backfill <br /> required(how large/deep will the excavation be?) and where it will be located on-site. You will <br /> also need to demonstrate that there will be sufficient backfill material available on-site, to both <br /> backfill the final dimensions of the pit to grade, as well as complete the rest of the reclamation as <br /> proposed. <br /> 4) The initial adequacy response provided discussed two cross-sections through the site to depict <br /> the final reclaimed configuration, however only one cross section was provided(2 copies of the <br /> A-A' cross section were submitted rather than one for A-A' and one for B-B'). Please provide <br /> the cross section for B-B'. <br />
