will seek to apply for the proper revisions to the 112c permit, with the necessary plans for the affected <br /> areas in Phase II. <br /> At this time, since there are no disturbances planned for anything north of the electric lines, many of the <br /> mining and reclamation maps only include the Phase I area, and are clearly labeled as such. Under our <br /> interpretation of this rule, we are not precluded from providing maps which show only a portion of the <br /> permit area, as long as they are labeled properly. Numerous maps in this conversion application do <br /> depict the entire 146-acre 112c area, particularly those depicting overall surface and mineral ownership, <br /> which is complicated in this site. <br /> Rule 6.2.1(2)(e)—We are not aware of any maps that have been submitted already whose scales and <br /> legends are not correct and appropriate. If any are not correct, please specify which ones. <br /> We have included several maps In Exhibit C variously showing different aspects of the complicated <br /> pattern of surface and mineral ownership, unpatented (leased) claims, and easements, which, if viewed <br /> as a set reveal the area that Colorado Quarries has full access to. The unpatented (Sullivan Lode) claims <br /> are further described in the lease documents provided in Exhibit N. The ownership maps,which are not <br /> cluttered with Mining or Reclamation features, are provided at 1 inch = 660 feet, except for one <br /> supplemental map provided at 1 inch = 1500 feet. (It is on a BLM map base, and being included to <br /> provide additional ownership clarity, should be acceptable under this Rule.) <br /> Exhibit C—Pre-mining and Mining Plan Maps <br /> Several new and revised maps are being submitted to address your concerns. <br /> Please see the updated land ownership maps,which now do not rely on the county assessor's mapped <br /> data, which was found to be inaccurate. The several ownership maps provided with this letter reflect the <br /> complex arrangement of private and public land, and surface and mineral estates. The information <br /> depicted will correlate with the lists of owners and documents reflecting right-of-entry. <br /> You stated that it would be useful to see a map showing a 200-foot buffer around the proposed 112c <br /> permit area, and a new map is therefore included in this response packet. <br /> The Mining Plan Map we submitted was clearly titled as the Phase I map, whose activities are limited to <br /> the southern half of the proposed area (south of the electric lines). This conforms with the original <br /> Exhibit D narrative, stating that there will be no activities proposed or described within the context of <br /> this 112c conversion application to be conducted in the northern half(or under a Phase II). That means <br /> there will be no affected lands in the northern half of this 112c permit area, until we apply for proper <br /> revision to the permit. Therefore, the Phase I Mining Map, as originally submitted, should be correct. <br /> We additionally clarified this with the statement that there would be no Phase II mining activities <br /> conducted without submitting appropriate revision application materials to the Division. <br /> Vegetation can be characterized as typical for rangeland at this 8,000-foot elevation, and is uniform <br /> across the entire site. Species information was provided under Exhibit J, and as your adequacy review <br /> letter stated, it was adequate. No vegetation information is therefore being added to the maps in this <br /> exhibit. <br /> There is one significant structure within 200 feet of the proposed permit boundary, located east/ <br /> southeast of the proposed boundary. This is a house belonging to Danny Ray Cherry. The nearest <br /> proposed mining-related activity is the establishment of the permanent overburden disposal area. You <br />
