Dear Sir or Madam:

This letter, as required by Rule 3.03.2(4)(b) of the Rules and Regulations, is to inform you that the
Division of Reclamation, Mining and Safety has issued a proposed decision to approve Surety Increase
No. 2 for the Terror Creek Loadout. This decision will be published in the Delta County Independent as
soon as possible. The first day following publication of the notice initiates a thirty (30) day public
comment period. If, within thirty days, there are no requests for an adjudicatory hearing, the decision will
become final.

The bond for the operation is a Corporate Surety issued by your company (Bond No. *9010), in the
amount of $290,000.00.

The reclamation liability prior to this proposed adjustment was $203,796.00. The proposed increase in
liability is $11,218.00. The new reclamation liability amount is $215,014.00.

Please be aware that this notification is not a request to initiate any action by Lexon Insurance Company
concerning Bond No. *9010, and is for your information only. Should Oxbow Mining, LLC choose to
take action with regard to this liability increase, they will contact you.
