<br /> <br />Notice of Proposed Decision <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to approve <br />Surety Increase No. 2 (SI-2) for the Terror Creek Loadout, Permit No. C-1983-059. The mine is <br />operated by Oxbow Mining, LLC under the provisions of the Colorado Surface Coal Mining <br />Reclamation Act of 1979. Surety Increase No. 2 (SI-2) was initiated by the Division following a <br />recalculation of the site-wide Reclamation Cost Estimate with Mid-Term Review No. 8 (MT-8), <br />using unit costs updated on July 1, 2021. The affected area is located in Delta County, approximately <br />4 miles Northeast of Paonia, Colorado. <br /> <br />Copies of the proposed decision are available for review at <br />https://dnrweblink.state.co.us/drms/search.aspx by searching C1983059 in the “Permit No” field. <br />A user guide is available to help first time users of the imaged document system and can be viewed <br />at https://drive.google.com/file/d/1l8OUdf_Mpjo3kxIHkP5hMH-w7MeBtxX7/view.. <br /> <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within <br />thirty (30) days of the date following initial publication of this notice, and shall state with reasonable <br />specificity the reasons for the request and objections to the proposed decision. <br /> <br />
