They are numbered 1 —5 to correspond <br /> with items 1-5 from your letter: <br /> 1. Financial Warranty Corporate Surety Forms in the name of Oldcastle SW Group,Inc are enclosed with <br /> this letter and will replace the old financial warranties. <br /> 2. The current corporate surety on file will not be updated with the new company name. Financial Warranty <br /> Corporate Surety Forms in the name of Oldcastle SW Group,Inc are enclosed with this letter and will <br /> replace the old financial warranties. <br /> 3. Affidavit of Authority forms for the above referenced permits are enclosed with this letter. <br /> 4. We are currently in the process of obtaining new Structure Agreements,however we formally request the <br /> deadline be extended approximately 1 month, to November 10h. This extended deadline is needed to <br /> personally deliver structure agreements and have them notarized in the rural areas of the involved parties. <br /> Also,we are simultaneously processing multiple other Succession of Operator applications and related <br /> documents during this busy construction season. The extra time will help ensure we do not exceed <br /> any set deadlines. <br /> 5. A complete list of all reclamation permits currently under Oldcastle SW Group,Inc. is enclosed with this <br /> letter. <br /> We believe this letter and the enclosures sufficiently address all items the DRMS asked us to address, with <br /> the exception to item 4, regarding structure agreements. As mentioned above we formally request the deadline <br /> to submit the structure agreements be extended to November 16`h. The deadline allows us more time to <br /> personally deliver structure agreements and have them notarized in the rural areas of the involved parties.
