Walstrum Spur Amendment, Exhibit D—Mining Plan revised September 2021 <br /> EXHIBIT D - MINING PLAN <br /> 6' <br /> 1.0 INTRODUCTION <br /> Albert Frei & Sons, Inc. (AFS), the Operator/Applicant, is proposing the Walstrum Spur Amendment (Spur <br /> Amendment) to continue the existing Walstrum Quarry (Existing Quarry) that has supplied aggregate construction <br /> materials for industrial, commercial, and residential uses since 1983. AFS is seeking to obtain an amendment to <br /> DRMS Permit M-1983-033 and the necessary land use approvals from Clear Creek County. <br /> This mining plan encourages the orderly development of the state's natural resources while reclaiming the land so <br /> that the affected land may be put to a beneficial use. The plan set forth fosters and encourages the development <br /> of an economically sound and stable mining and construction materials industry. <br /> The following terms are used to describe distinct major areas within the mine permit boundary: <br /> • Existing Quarry — All areas currently permitted under DRMS Permit No. M-1983-033, including Parcels <br /> A2, 131, C1, C2, C3, D, and E totaling 285.7 acres. <br /> • Spur Amendment—Areas proposed to be permitted, including Parcels Al, B2, F, G, H1, H2, I, J, K, and L <br /> totaling 463.6 acres. <br /> The Existing Quarry and Spur Amendment are located within unincorporated Clear Creek County, Colorado. The <br /> site is 4 miles east of Idaho Springs, just east of the junction of Highway 6 and Interstate 70, on the north side of <br /> Highway 6. It sits predominantly within Sections 34, 35, and 36, Township 3S, Range 72W, 611 P.M. (and portions <br /> of Sections 2 and 3, Township 4S, Range 72W of the 6th P.M.). The geographic coordinates for the main entrance <br /> area are 39.745988° North, 105.434214' West. The geographic coordinates for the secondary entrance are <br /> 39.742481° North, 105.430006' West. <br /> The Existing Quarry is mined by AFS on land owned by the Albert and Mary Jane Frei Irrevocable Trust (Trust) <br /> and the AR & MJ Frei Limited Partnership (Partnership). The mining activities within the Existing Quarry are <br /> conducted in accordance with affidavits from the Trust and the Partnership granting mining rights to AFS. The <br /> proposed Spur Amendment is on land owned by the Trust. Affidavits granting rights to AFS for mining activities <br /> are presented in Exhibit N. <br /> If mining activities encounter any indications of the presence of human bones, work will stop in the immediate <br /> vicinity and the materials avoided until qualified individuals can perform further due diligence. <br /> NTETRA TECH P a g e 1 19 <br />
