(9) Upland meadows on the northern portion of the East Cell and along the portion of the <br /> conveyor alignment along the City of Aurora Challenger Reservoir site in Adams County <br /> will be graded to allow for access to maintain the area. <br /> (10) Al may backfill material generated within the MLRB permitted area into an <br /> excavated pit within the permit area. Al may import inert structural fill material onto the <br /> site for backfill. Prior to import of inert structural fill generated outside of the approved <br /> permit area, Al will provide DRMS with notice of any proposed backfill activity not <br /> identified in the approved Reclamation Plan. Al will maintain a Financial Warranty at all <br /> times, adequate to cover the cost to stabilize and cover any exposed backfilled material. <br /> The Notice to DRMS shall include, but is not limited to: <br /> (a) a narrative that describes the approximate location of the proposed activity; <br /> (b) the approximate volume of inert material to be backfilled; <br /> (c) a signed affidavit certifying that the material is clean and inert, as defined in Rule <br /> 1.1(20); <br /> (d) the approximate dates the proposed activity will commence and end, however, such <br /> dates shall not be an enforceable condition; <br /> (e) an explanation of how the backfilled site will result in a post-mining configuration that <br /> is compatible with the approved post-mining land use; and <br /> (f) a general engineering plan stating how the material will be placed and stabilized in a <br /> manner to avoid unacceptable settling and voids. <br /> (11) All mined material to be disposed of within the affected area will be handled in such <br /> a manner to prevent any unauthorized release of pollutants to the surface drainage <br /> system. <br /> (12) No unauthorized release of pollutants to groundwater shall occur from any materials <br /> mined, handled or disposed of within the permit area. <br /> More specific information regarding how Al will comply with the performance standards <br /> is outlined below. <br /> Final Proposed Land Use <br /> The current land use for the Tucson South Resource property is a combination of <br /> partially reclaimed mining area, reclaimed mining area, and dryland and irrigated <br /> agriculture, upland meadow and a City of Aurora water facility. The City of Aurora water <br /> facility (located outside the Affected Lands, west of the Brighton Ditch) will be removed <br /> from the Permit Boundary at a future date and continue to operate. The proposed final <br /> land use for the remainder of the property is lined municipal water storage for the West <br /> cell and the majority of the East cell, upland meadow on the northern portion of the East <br /> cell and conveyor alignment along the City of Aurora Challenger Reservoir, and irrigated <br /> and dryland agriculture along the Weld County portion of the conveyor alignment. <br /> Surrounding land uses include: Water storage to the north, rural residential and <br /> agriculture to the south and along the Weld County portion of the conveyor alignment, <br /> Town of Brighton wildlife conservation area and the South Platte River to the east and <br /> water storage and suburban residential to the west. The lined storage and upland <br /> meadows are compatible with existing and future adjacent land uses.
