J-2 Contracting Co.—DPG Pit— Technical Revision No. 1 Adequacy Review Response <br /> File No. M-2019-028 <br /> -4- <br /> Response: The Reclamation Maps (F-1 and F-2) have been updated to show the <br /> locations of the inleUoutlet structures. The design for the structures remains the same <br /> but with the different reclaimed reservoir configuration there are not as many structures <br /> needed. See the attached Figure 1 - West Cell, and Figure 2- East cell by Galloway for <br /> the spillway details. <br /> Exhibit L- Reclamation Costs <br /> 8. The Division reviewed and will accept the revised Exhibit L - Reclamation Costs estimate <br /> provided by the Operator. During a site inspection on May 26, 2021. The Operator stated mining <br /> activities in Phase 1 would commence soon and the Phase 2 and 5 slurry wall was observed <br /> being installed during the inspection. Please commit to providing the proposed revised <br /> Reclamation Costs for Phase 1 and 2 for a cumulative financial warranty of$5,344,459.00. This <br /> is an increase of $4,359,893.00 from the currently held financial warranty in the amount of <br /> $984,566.00. <br /> Response: The Operator will not be commencing mining activities in Phase 2 until a later <br /> date, as they will only be mining in Phase 1 the remainder of 2021 and into the first <br /> quarter of 2022. The Phase 5 surface will also be disturbed for processing and product <br /> stockpile activities. A revised reclamation bond quantities and costs calculation <br /> including the disturbed Phase 5 surface area is attached. A revised Exhibit L <br /> Reclamation Phasing Map including the disturbed Phase 5 surface area is also attached. <br /> As currently provided the existing financial warranty covers the Phase 1 mining and <br /> disturbed areas by more than what is calculated in the attached Exhibit L - Reclamation <br /> Costs. If the Operator needs to open Phase 2 they will commit to increasing the financial <br /> warranty. <br /> 9. Please confirm the Operator commits to submitting a technical revision to increase the <br /> maximum disturbed area and revise the bond estimate prior to creating additional disturbance <br /> outside of Phases 1 and 2 if the proposed technical revision is approved by the Division. <br /> Response: The Operator commits to submitting a technical revision to increase the <br /> maximum disturbed area and revise the bond estimate prior to creating additional <br /> disturbance outside of Phase 1 and 2. <br /> 10. Please confirm the Operator is requesting to reduce the maximum disturbed area from the <br /> currently approved 92.55 acres to 84.98 acres. <br /> Response: The Operator is not requesting to reduce the maximum disturbed area. With <br /> the addition of the Phase 5 surface area disturbance the Operator is requesting that the <br /> maximum disturbed area be 102.69 acres. <br /> Hydraulic Analysis Report <br /> 11. The Delta Reservoir West Cell Preliminary and East Cell Conceptual Design report by Galloway <br /> & Company, Inc. dated April 16, 2021 is under review by the Division. An additional adequacy <br /> letter for the report will be issued by the Division under separate cover, if required. <br /> Response: The Applicant received response comments for this item from the Division in <br /> a letter dated July 19, 2021.
