The documentation indicates that the permit is <br /> intended for an approved CDOT project where the borrow material from the Raindance Reservoir#2 site will be <br /> utilized for road construction associated with the North I-25 Express Lanes. As the borrow materials are directly <br /> connected to a U.S. Department of Transportation undertaking,please note that it is the Federal agency's <br /> responsibility to meet the requirements of Section 106 of the National Historic Preservation Act(NHPA)as set <br /> forth in 36 CFR 800. <br /> Section 106 of the NHPA includes not only reasonable and good faith identification efforts of any historic <br /> properties located within the area of potential effects,but determining whether the undertaking will have an effect <br /> upon such properties. The State Historic Preservation Office,Native American tribes,representatives of local <br /> governments, and applicants for federal permits are entitled to consultative roles in this process. <br /> We thank you for the opportunity to comment.
