OUR,AY-5LVER MCVEs <br /> 1.2 Professional Engineer Certification (40 CFR 112.3(d)) <br /> The undersigned Registered Professional Engineer is familiar with the requirements of Part 112 <br /> of Title 40 of the Code of Federal Regulations (40 CFR part 112) and has visited and examined <br /> the facility, or has supervised examination of the facility by appropriately qualified personnel. <br /> The undersigned Registered Professional Engineer attests that this Spill Prevention, Control, <br /> and Countermeasure Plan has been prepared in accordance with best engineering practice, <br /> including consideration of applicable industry standards and the requirements of 40 CFR part <br /> 112;that procedures for required inspections and testing have been established; and that this <br /> Plan is adequate for the facility. [40 CFR 112.3(d)] <br /> This certification in no way relieves the owner or operator of the facility of his/her duty to <br /> prepare and fully implement this SPCC Plan in accordance with the requirements of 40 CFR part <br /> 112.This Plan is valid only to the extent that the facility owner or operator maintains, tests, and <br /> inspects equipment, containment and other devices as prescribed in this Plan. <br /> 1.2.1 Required Improvements <br /> The Professional Engineer's certification of this plan is contingent on the following facility <br /> improvements being implemented for compliance with SPCC regulations 40 CFR 112: <br /> 1) Emergency spill kit items must be placed near hydrocarbon use areas for use <br /> on the entire site. Spill Kits should include impervious containers with <br /> absorbent socks, pillows, pads,gloves,goggles, disposal bags,ties, <br /> instructions and labels. <br /> 2)Training of personnel must occur per Section 3.8 of this plan and designated <br /> employees must become familiar with the spill kit items,their use and proper <br /> reporting in the case of a spill. <br /> Name: Brian K.
