3) This TR also addresses the identification of all pit floor areas remaining after final highwall <br /> build out in Phases 2, 3, 4 and 5 of the BLM land and the remaining 29 acres of privately <br /> owned Phase 5 permitted area. In short, this TR addresses bond coverage for all remaining <br /> BLM lands as well as all private land currently under permit within the confines of the 5660' <br /> pit floor elevation, i.e., 123.3 acres fully bonded private land of the 235 acres of private land <br /> permitted, as well as 79 acres of BLM land fully bonded. <br /> 4) In order to accurately identify the maximum pit floor area exposed in each Phase area at full <br /> build out of highwall benches, a third party engineering firm (RESPEC) was contracted to <br /> produce a final build out map showing the maximum floor area remaining within each Phase <br /> area as well as a projected mine bench highwall topographic map that allows for accurate <br /> measurement of linear feet of bench run within each Phase area. This map will be submitted as <br /> Exhibit F, (as directed by Stipulation No. 7) for purposes of identification of each Phase area's <br /> topsoil and revegetation requirements at the time of final highwall build out. This projection of <br /> mine site conditions at time of maximum highwall build out also coincides with the maximum <br /> potential acres of pit floor remaining, meaning that the maximum potential acreage to be <br /> reclaimed is reflected in the bond calculation. <br /> 5) The Division was contacted prior to bond calculation and 2021 estimations of costs of Owning, <br /> Operating, Labor and Materials were used as noted. The CIRCES bond calculation format was <br /> followed as much as possible with notes identifying equipment capacities, costs to own and <br /> operate, and material characteristics. For purposes of clarity, each Phase will be addressed <br /> individually with notations. Certain assumptions were made at the onset of bond calculation. <br /> Due to the fact that mining and reclamation will proceed from south to north over the site, a <br /> similar haul distance of topsoil (500') was used for each Phase area. Similar material densities <br /> were used for each Phase area. Phase 1 Tasks 110 through 190 identify each work task to be <br /> undertaken in that area: Topsoil Haulage and placement, Rough Grading of topsoil, Bulldozer <br /> Ripping, Revegetation Work, Bulldozer Final Grading of Mine Bench Runs, Permanent <br /> Structure Demolition, and Mob/Demob costs presented per the 2013 bond calculation made by <br /> the Division. <br /> 6) Phases 2, 3, 4, and 5 will be presented in the same manner as Phase 1 with Phase 5 split <br /> between BLM land and private land areas. Demolition and Mob/Demob cost estimates are <br /> presented only in Phase 1 estimates. The Task Summaries are submitted for each Phase. The <br /> individual worksheets for the Phase 1 Tasks were constructed to show equipment productivities <br /> and material amounts for each task with associated costs. Phase 2 through 5 used the same <br /> equipment costs with noted differences in material volumes encountered in each Phase area. <br /> The following noted changes and considerations for each Phase of Bond Calculation: <br /> Phase 1 Area- 123.3 Acres Tezak owned land <br /> l) Increase in fully bonded acreage from 40 acres topsoiled and 90.5 revegetated to 123.3 <br /> acres topsoiled and revegetated. <br /> 2) Scraper used was changed to a Cat 631 G from smaller 621 G, resulting in significantly <br /> higher O&O costs but also higher productivities (DRMS sourced data). <br /> 3) Mine Bench Maintenance bonding calculation (Task 150) changed from motor grader used <br /> to a D-5 Bulldozer used to grade final bench ditches along each bench run.
