Preliminary review of the information <br /> received determined the following items must be received before the Division can consider the <br /> application as being submitted and technical review can begin: <br /> Application Form <br /> 1. On Page 1, Item #3 of the application form, the Applicant indicates the site is permitted for 30 <br /> acres and the Applicant intends to add 61.1 acres for a total permitted acreage of 91.1 acres. <br /> The Division approved a 111 Special Operations Reclamation Permit on May 10, 2021 for a <br /> portion of the proposed site. 111 Special Operation permit amendments are not allowed by <br /> statute, pursuant to Rule 1.10.2. The Division will require the Applicant to permit over the <br /> existing 111 site with the 112 application. Please revise Item #3 to indicate the total proposed <br /> acreage of 91.1 acres. The has been corrected. See revised application attahced. <br /> 2. The Division requires the permit application list the exact company name registered with <br /> the Colorado Secretary of State, "VIMA Partner, LLC'. Please revise the company name on <br /> the Company name and notary sections of the certification page, Page 8, of the application <br /> form, to indicate "VIMA Partner, LLC', instead of"VIMA Partner LLC'. <br /> The has been corrected. See revised signature page attached. <br /> 6.4.1 Exhibit A- Legal Description <br /> 3. Rule 6.4.1(1) states the legal description shall be by,township, range and section,to at least <br /> the nearest quarter-quarter section. The Applicant provided the legal description to the <br /> nearest half section only in Exhibit A. Please provide the legal description to the nearest <br /> quarter-qua ter section as required by Rule 6.4.1 in Exhibit A. <br /> Exhibit A has been updated to nearest quarter quarter.
