LYOANSNGADDIS <br /> DIVISION OF RECLAMATION, MINING, AND SAFETY <br /> Page 3 <br /> August 3, 2021 <br /> The thickness of the material to be mined does vary, but will not exceed 13 feet in <br /> depth, and may be significantly less in areas, regardless of where such material is <br /> mined. <br /> EXHIBIT E— Reclamation Plan (Rule 6.4.5): <br /> 9. There are three ponds/lakes that are proposed to be within the permit boundary, please <br /> demonstrate or commit to constructing the ponds/lakes to meet Rule 3.1.5(7) which states; In all <br /> cases where a lake or pond is produced as a portion of the Reclamation Plan, all slopes, unless <br /> otherwise approved by the Board or Office, shall be no steeper than a ratio of 2:1 (horizontal to <br /> vertical ratio), except from 5 feet above to 10 feet below the expected water line where slopes <br /> shall be not steeper than 3:1. If a swimming area is proposed as a portion of the Reclamation <br /> Plan, the slope, unless otherwise approved by the Board or Office, shall be no steeper than 5:1 <br /> throughout the area proposed for swimming, and a slope no steeper than 2:1 elsewhere in the <br /> pond. <br /> The ponds and lakes are already present on the property. One will be eliminated, <br /> and the other 2 will be utilized on the property. The Applicant commits to construct <br /> the ponds/lakes to meet the requirements of Rule 3.1.5(7). <br /> 10. What is the source of the water to be used to fill the ponds? If there is an augmentation or <br /> substitute water supply plan in place to fill the ponds please provide a copy of the plan. <br /> The source of the water used to fill the ponds is run-off water as well as dedicated <br /> water. The Applicant is presently working with Wright Water Engineers, Inc. on an <br /> augmentation plan, although such plan is not finalized at this time. <br /> EXHIBIT F— Reclamation Plan Map (Rule 6.4.6): <br /> 11. The map provided in Exhibit F is inconsistent with the maps that are included in the Reclamation <br /> Plan Exhibit E, please revise the map to be consistent with Exhibit E. <br /> A revised Exhibit F is included with this letter. <br /> EXHIBIT H —Wildlife Information (Rule 6.4.8): <br /> 12. The Colorado Parks and Wildlife provide comments on the permit application, see attachment. <br /> Please provide responses to their comments and concerns. <br /> Applicant, which is also the developer of the land in the proposed permitted areas, <br /> addressed the concerns of Colorado Parks and Wildlife in their Final Development <br /> Plan, which was subsequently approved by all applicable government authorities. <br /> The applicant notes the CPW recommendations. Within the scope of the PUD and <br /> Final Development Plan, WSA, and the ordinances of the Town, the applicant will, <br /> where reasonable, fulfill the recommendations of the CPW to minimize issues <br /> related thereto, and will otherwise follow the procedures set forth for the area when <br /> the Shorefox Mining Permit obtained by the Town. <br />
