Baurer Pit, Permit No. M-2020-058 Dear Mr. Cunningham: . The following discussion and attachments are submitted on behalf of our client, Aggregate Industries —WCR, Inc., in response to the Adequacy Review comments prepared by the Division of Reclamation, Mining and Safety dated April 9, 2021, for the Baurer Pit 112 Construction Materials Reclamation Permit application. The information and discussion below address each comment as it was presented by the Division: 6.4.3 Exhibit C—Pre-Mining and Mining Plan Maps of Affected Land 1. The topography illustrated on the revised Exhibit C-1, Existing Conditions and Exhibit C-5, Pre-Mining/Mining Plan Map has been updated to include the existing pit lake and labeled such that the affected land direction and rate of slope is more accurately portrayed. Revisions were also made to the Exhibit C-1, Existing Conditions, property owner table (Property Owners and Man-Made Structures within 200 Feet of Affected Land). The table was updated with new contactJaddress information for Hall-Irwin Aggregates and Xcel Energy. Additionally, CenturyLink was added as a structure owner to the table. CenturyLink was a late responder to our utility locate request and, although their buried communication lines along Weld County Road 23 1/z were not in the original application submittal materials, their structure is included in the revised exhibit. Additionally, the same owner and contact/address information revisions have been made to the table in Exhibit S, Permanent Man-Made Structures within 200 Feet of the Affected Land. 6.4.4 Exhibit D—Mining Plan 2. Aggregate Industries acknowledges the permit stipulation that a 200-foot buffer will be maintained around all structures until structure agreements andlor slope stability analyses are obtained. Agreements have been offered to all owners of man-made structures within 200 feet of the affected area. The certified letter receipts are attached.
