Remarks:
First, we apologize for needing to send another certified mailing letter and any inconvenience it may
cause you. Aggregate Industries — WCR, Inc. is in the process of obtaining a Colorado Division of
Reclamation, Mining and Safety (DRMS) permit for the mining of aggregate materials in Weld County
(see Vicinity Map). The mining will include excavation to maximum depths of about 30 feet below the
ground surface and reclamation will involve installation of a slurry wall, grading to create stable
slopes, and creation of a below-grade reservoir.
As part of the permitting, DRMS requires Aggregate Industries to offer an agreement to owners of
man-made structures within 200 feet of the proposed mining activities. Aggregate Industries has
identified permanent man-made structures owned by DCP Midstream within or adjacent to the project
(see Pre-Mining/Mining Plan Map). To protect your interests in the structures, Aggregate Industries is
offering an agreement that provides DCP Midstream compensation for structure damage. An
initial/example agreement is attached. If DCP Midstream is already in discussions with Aggregate
Industries —WCR, Inc. regarding agreements to remove or protect structures at this location, you may
disregard this letter.
Mine planning has established appropriate setbacks from mining excavations to adjacent structures,
including those owned by DCP Midstream, and Aggregate Industries does not anticipate any structure
damages. However, to ensure your interests are protected, we request that you please consider the
enclosed Structure Agreement.
If a representative of your organization will please sign and return the agreement to us, Aggregate
Industries — WCR, Inc. will in-turn sign the agreement and we will return a copy of the completed
