Lessee shall maintain an accurate scale (or scales) over which all <br /> material removed from the Property shall be weighed and accurate records of all weights, <br /> including weights of haul vehicles. The scale and records shall be available for inspection by <br /> Lessor at all reasonable times. <br /> Lessee agrees to keep a strict and accurate record of all materials removed from the <br /> Property and all sales thereof,and Lessor shall have the privilege at reasonable times of examining <br /> the mining procedures and checking the books and records of Lessee for the purpose of verifying the <br /> royalty payable <br /> Lessee shall forward to lessor monthly reports showing the quantity of material removed during the <br /> preceding month,according to load tickets,with dates of loading. Such reports will be forwarded to Lessor <br /> by the twentieth day of the month following the month in which material is removed. It is understood that <br /> during certain months of the year it may be impracticable to remove materials because of weather conditions, <br /> and no report will be required for any month during which no material has been removed. The Lessee <br /> shall provide daily emailed scale ticket summaries to the Lessor. The Lessee will also install and <br /> maintain video cameras to monitor and record the truck traffic coming into and out of the Property. <br /> This video monitoring is dependent upon enough internet capacity to provide adequate service for <br /> such monitoring. Lessee shall make such video feed and recorded video files accessible to Lessor <br /> through an online access system. <br /> Lessee shall not be required to pay a royalty based on material used by Lessee in <br /> maintaining existing repairs for the roadways on the Property. The Lessee shall provide reports to <br /> the Lessor for any material used for road repairs which are excluded from the royalty payments <br /> called for herein. <br />
