6.4.13 Exhibit M <br /> Other Permits and Licenses <br /> The following permits are required by the applicant for the operation of the Penrose Pit. <br /> Fremont County <br /> Conditional Use Permit <br /> The current Conditional Use Permit is good for the life of the mine but will be updated <br /> with the additional acreage when DRMS approval is ascertained. Fremont County has been <br /> contacted and is aware of this process. <br /> Colorado Department of Public Health and Environment <br /> Air Pollutant Emission Notice <br /> The applicant has a current APEN and Emission Permit (10FR2157F). As this amendment <br /> will not increase production rates or total disturbed area, there is no requirement to <br /> amend it. <br /> Colorado Department of Public Health and Environment <br /> Stormwater Discharge Permit <br /> The applicant has a current Stormwater Discharge Permit (COR340894). This permit will <br /> be amended, and the Stormwater Management Plan updated to reflect the revised <br /> permit boundary. <br /> Colorado Department of Transportation <br /> State Highway Access Permit <br /> The applicant has a current access permit (296085) which will allow them to construct <br /> and use an access to State Highway 115. <br />
