Notice of Proposed Decision
The Colorado Division of Reclama-
tion, Mining and Safety has issued a
proposed decision to approve Bond
Release Application No. 7 (SL-7)
for the Bowie No. 1 Mine, Permit
No. C-1981-038. This bond release
application pertains to the ROM
Area of the mine site, including
the pond. The SL-07 application
included Phase III bond release on
10.72 acres (the entire ROM Area,
including the pond and the entrance
road) and a Phase II bond release
on 0.51 acres (the pond within the
ROM Area). The Division is not
proposing to release 0.34 acres for
the entrance road, and the resulting
Phase I II acreage is 10.38 acres
(10.72 - 0.34). The road area was
removed from consideration for
bond release because the recla-
mation plan for Bowie No. 1 Mine
does not clearly indicate that this
shall be a permanent facility. The
underground operation is operated
by Bowie Resources, LLC under the
provisions of the Colorado Surface
Coal Mining Reclamation Act of
1979. The bond release application
was submitted by Bowie Resources,
LLC on April 1, 2021. This bond
release application pertains to the
ROM Area of the mine site, includ-
ing the pond. The SL-07 application
included Phase III bond release on
10.72 acres (the entire ROM Area,
including the pond and the entrance
road) and a Phase II bond release
on 0.51 acres (the pond within the
ROM Area). The affected area is lo-
cated in Delta County, approximately
3 miles North of Paonia.

fected may request an adjudicatory
hearing regarding this proposed de-
cision. Requests for a hearing must
be made in writing within thirty (30)
days of the date following initial
publication of this notice, and shall
state with reasonable specificity the
reasons for the request and objec-
tions to the proposed decision.
