NOTICE OF PROPOSED DECISION The Colorado Division of Reclamation, Mining and Safety proposes to approve Permit Renewal Application No. 9 (RN- 9), submitted by ARC McClane Canyon, LLC for a coal mining permit at the McClane Canyon Mine (Permit No. C-1980-004). The proposed renewal will allow for continued mining and/or rec- lamation operations at the site. The McClane Canyon Mine is a/an underground operation located in Garfield County, approximately 19 miles North of Loma, Colorado. Coal interest is federal and private, and the surface to be affected is federal and private land. The permit area encompasses approximately 3,561.40 acres. This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclama- tion Act, Section 34-33-101 et seq., C.R.S., and the regulations promulgated thereunder. A copy of the "Proposed Deci- sion and Findings of Compli- ance", including any stipulations, is on file for public inspection at the Mesa County Clerk and Recorder, 200 S. Spruce Street , Grand Junction, CO 81501. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such re- quest must be made within thirty (30) days of the date following initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the proposed decision.
