Our
initial review indicates that all preliminary items required by Rule 2.08.4(5) have not been
submitted. Thus, your application is incomplete for the purposes of filing as of July 2, 2021.

The following items will need to be addressed regarding the public notice:

1. The public notice needs to be revised to cite the entire permit number for the operation, C-1981-
012.

2. The legal description provided in the notice does not appear to cover the entire permit boundary,
facilities area, the vent shaft for the Golden Eagle Mine, and the Jansen Loadout as well as all the
U.S. Geological Survey 7.5 minute quadrangle maps(s) which contain the permit area. In
accordance with Rule 2.07.3(2)(b) a map may be used to clearly show or describe the exact location
and boundaries of the proposed area.

3. In accordance with Rule 2.07.3(4) the applicant must make a full copy of the complete
application available for review at the recorder’s office at the courthouse of the county where
mining is proposed to occur. A copy of the complete application must be put on file for public
review at the county clerk and recorder’s office. Therefore in accordance with Rule 2.07.3(2)(c)
please revise the public notice to include the location where a copy of the application is available for
public inspection in addition to the DRMS website.

4. With the approval of TR74, the total approved affected area is 227.8 acres of affected land, please
