NOTICE OF PROPOSED DECISION The Colorado Division of Reclamation, Mining and Safety proposes to approve Technical Revision Application No. 96 (TR-96) for the Foidel Creek Mine (Permit No. C-1982-056), submitted by Twentymile Coal, LLC. TR-96 was submitted following the Divisions Surety-Increase No. 3 (SI-3). SI-3 was initiated by the Division after the Mid-Term No.8 Reclamation Cost Estimate update. TR- 96 removes approved permitted action that were not conducted. SI-3 was withdrawn by the Division due to the submittal and approval of TR-96. The Foidel Creek Mine is a/an underground coal mine located in Routt County, approximately 23 miles SW of Steamboat Springs, Colorado. Coal interest is federal, state and private, and the surface affected is federal, state and private land. The permit area encompasses approximately 22,647.00 acres. This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., and the regulations promulgated thereunder. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made within thirty (30) days of the date following initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the proposed decision.
