Minor Revision No. 63 (MR-63) was withdrawn on September 25, 2020. The revision proposed <br /> an update to the identification of interests section in the C-1980-004 permit for the new owners <br /> of the mine. The minor revision was withdrawn and re-submitted as a Succession of Operators <br /> Application. <br /> Technical Revision No. 19 (TR-19) was withdrawn on August 10, 2020. The revision proposed <br /> to temporarily suspend surface and groundwater monitoring. The application was withdrawn <br /> due to the hydrologic monitoring program being unable to be reduced any further during <br /> temporary cessation. <br /> Succession of Operators Application No. 5 (SO-5)was issued on January 5, 2021. The revision <br /> approved the succession of operator to ARC McClave Canyon, LLC. The application also <br /> approved updates to the identification of interests section of the permit. <br /> Status of Stipulations <br /> The stipulation history for the McClave Canyon Mine was reviewed with this renewal <br /> application. The review included an investigation of any stipulations imposed and any responses <br /> to existing stipulations received since the last midterm review. Any stipulations associated with <br /> this permit and issued over the life of this operation which are not discussed in this midterm <br /> review have been complied with or terminated. <br /> STIPULATION NO. 27: <br /> SEDIMENT REMOVED FROM THE SEDIMENT POND MAY BE USED AS A <br /> TOPDRESSING OR TOPSOIL SUPPLEMENT PURSUANT TO RULE 4.06.2(4)(A),UPON <br /> SUBMITTAL OF CHEMICAL AND PHYSICAL ANALYSES DEMONSTRATING THAT <br /> THE MATERIAL IS EQUAL TO OR MORE SUITABLE FOR SUSTAINING VEGETATION <br /> THAN AVAILABLE TOPSOIL OR OTHER PLANT GROWTH MEDIA. SUCH <br /> DEMONSTRATION SHALL BE BASED ON A REPRESENTATIVE COMPOSITE SAMPLE <br /> OF THE MATERIAL OBTAINED FROM EACH POND CLEANOUT EPISODE. <br /> REQUIRED PARAMETERS WILL INCLUDE THOSE LISTED IN 4.06.2(4)(A), WITH THE <br /> EXCEPTION OF THICKNESS, DEPTH, COARSE FRAGMENTS, AND AERIAL EXTENT. <br /> ANALYSES FOR SELENIUM, BORON,NITROGEN, AND ORGANIC MATTER WILL BE <br /> INCLUDED IN ADDITION TO THOSE LISTED. POND CLEANOUT MATERIAL WILL <br /> NOT BE PLACED IN THE TOPSOIL STOCKPILE OR USED AS FINAL RECLAMATION <br /> TOPDRESSING PRIOR TO OBTAINING WRITTEN APPROVAL FROM THE DIVISION. <br /> Enforcement Actions <br /> There have been no enforcement actions were issued since the last midterm review of the <br /> McClave Canyon Mine permit application package. <br /> iii <br />
