`o COLORADO
® d Division of Reclamation,
Mining and Safety
Department of Natural Resources
1313 Sherman St. Room 215
Denver, CO 80203
June 15, 2021
Delta County Commissioners
County Commissioner
501 Palmer Street, 9227
Delta, CO 81416
Re: Bowie No. 1 Mine (Permit No. C-1981-038)
Bond Release Application No. 7 (SL-7)
Dear Delta County Commissioners:
This letter, as required by Rule 3.03.2(5)(a) of the Rules and Regulations of the Colorado Mined
Land Reclamation Board for Coal Mining, is to inform you that the Division of Reclamation,
Mining and Safety has issued a proposed decision to approve Bond Release Application No. 7 for
the Bowie No. 1 Mine. This decision will be published in the Delta County Independent as soon
as possible. The first day following publication of the notice initiates a thirty (30) day public
comment period. If, within thirty days, there are no requests for an adjudicatory hearing, the
decision will become final.
This bond release application pertains to the ROM Area of the mine site, including the pond. The
SL-07 application included Phase III bond release on 10.72 acres (the entire ROM Area, including
the pond and the entrance road) and a Phase II bond release on 0.51 acres (the pond within the
ROM Area). The Division is not proposing to release 0.34 acres for the entrance road, and the
resulting Phase III acreage is 10.38 acres (10.72 - 0.34). The road area was removed from
consideration for bond release because the reclamation plan for Bowie No. 1 Mine does not clearly
indicate that this shall be a permanent facility. As an interested party, you have the right to an
adjudicatory hearing as outlined under Rule 3.03.2(6) of the Rules and Regulations. The request
for an adjudicatory hearing must be written and state with specificity the reasons why the hearing
is requested. The request must be received within thirty days of the day following the first
publication of the proposed decision in the Delta County Independent.
Copies of the proposed decision and findings are available for review at
https://dnrweblink.state.co.us/drms/search.aspx by searching C 198103 8 in the"Permit No"field.
A user guide is available to help first time users of the imaged document system and can be viewed
OF COCO
1313 Sherman St. Room 215 Denver, CO 80203 P (303) 866-3567 F(303)832-8106 https://drms.colorado.gov
Jared Polis, Governor I Dan Gibbs, Executive Director I Virginia Brannon, Director I * *
*1876
