Enclosed is the Division's decision form and written findings. The proposed <br /> decision will be published in the Delta County Independent, as soon as possible. The first day <br /> following publication of the notice initiates a thirty-day public comment period. If there are no <br /> requests for an adjudicatory hearing within the thirty days, the decision will become final. <br /> This bond release application pertains to the ROM Area of the mine site, including the pond. The <br /> SL-07 application included Phase III bond release on 10.72 acres (the entire ROM Area,including <br /> the pond and the entrance road) and a Phase II bond release on 0.51 acres (the pond within the <br /> ROM Area). The Division is not proposing to release 0.34 acres for the entrance road, and the <br /> resulting Phase III acreage is 10.38 acres (10.72 - 0.34). The road area was removed from <br /> consideration for bond release because the reclamation plan for Bowie No. 1 Mine does not clearly <br /> indicate that this shall be a permanent facility.
